PLC Forum - Topical Limitation Issues


Description This forum is to be led by Geoffrey Topham of 3 Stone Buildings and Emma King, National Head of Pensions Disputes at Hammonds. Geoffrey will consider the case of Arjo Wiggins Ltd v Ralph [2009] EWHC 3198 (Ch) (07 December 2009) in which the High Court clarified the impact of limitation periods in complaints made to the Pensions Ombudsman. Geoffrey represented the successful Appellant. Emma will lead a session on aspects of limitation in a wider context. She will focus on the interaction between time periods in the Pensions Ombudsman Regulations and those of the Limitation Act 1980, ‘pure maladministration’ cases, issues in bringing claims within the limitation period, Section 14A and the 15 year long-stop date. The aim is for an interactive session rather than a lecture on the topic. We hope to encourage debate based on the experiences of delegates.
