Experience of Pensions Disputes, including Mediation:

·                    Acting for professional pension trustees, defending a claim brought by a trustee in bankruptcy concerning the interpretation of the pension scheme rules and in particular the provisions dealing with forfeiture; the case settled following the use of ADR

·                    Advising pension scheme administrators in High Court proceedings brought by a former scheme member alleging that the administrators failed to effect an instruction to transfer benefits to an alternative scheme

·                    Acting for the employer and trustees on an action in professional negligence against the "Barber" decision

·                    Advising a client (in its capacity as a scheme administrator) in a claim brought by an Independent Trustee on behalf of four deferred members who claim that in spite of transfer requests being made, no action was taken

·                    Acting on behalf of the purchaser in connection with a contractual claim against the vendor to recover a pension shortfall under the terms of an asset sale agreement.

Professional Background, including Pensions Experience:

Upon qualification in 1997 I joined Osborne Clarke’s commercial litigation department in Bristol, becoming an Associate in 2000.  I joined Shoosmiths as a Partner in November 2009, and work closely with the pensions team advising in relation to contentious issues.  I am based in Shoosmiths’ Solent office.

Mediation style

My aim is to quickly gain the trust of participants, and encourage a frank and thorough appraisal by all parties of the strengths and weaknesses of their respective cases. 

I am keen not to allow the mediation process to drift and can be tough where required, but I am committed to helping participants find an acceptable resolution.
